By accessing or using this website or any other websites of 4Keeps Matchmaking Services and its affiliates ("4Keeps," "we," "our") that link to this agreement (collectively, the "Site") in any way, you represent that: (1) you have read, understand, and agree to be bound by these Terms of Use; (2) you are of legal age to form a binding contract with 4Keeps; and (3) you have the authority to enter into these Terms of Use personally or on behalf of any entity you have named as the user. If you do not agree to be bound by these Terms of Use, you may not access or use this Site or the services. These terms also apply to potential matches who sign up, via our website or otherwise, to be matched with our clients.
Through the Site, you may provide personal information for us to use in our offline matchmaking services ("Matching"). We do not perform Matching on the Site itself. By providing such personal information, you authorize us to disclose this information to our clients as part of the matchmaking process.
By registering to use the Matching, you represent and warrant that you are at least 18 years old, are legally able to date and enter into relationships, have never been convicted of a felony, and are not required to register as a sex offender with any government entity. You agree that these representations are material to our decision to provide services and that providing false information is grounds for immediate termination without refund.
4Keeps relies on the representations that members, clients, and matches make about themselves. We do not conduct criminal background checks, identity verification, or other formal screening, and we make no representation that any person is who they claim to be, has provided accurate information, or is safe to meet. We reserve the right to review information provided to us and to remove anyone who violates these Terms, but we are under no obligation to investigate any person. You are solely responsible for deciding whether to communicate with or meet any person we introduce.
Matching requires your completion of a registration questionnaire. We do not guarantee that the Matching will provide any matches at all, or that you will be contacted as a result of the Matching. Matchmaking is a personal, human process and outcomes vary by individual.
Meeting and dating other people carries inherent risks. You understand and agree that you communicate with, meet, and interact with any match, member, client, or other person entirely at your own risk. You are responsible for taking reasonable safety precautions at all times, including meeting in public places, telling someone where you will be, arranging your own transportation, and using your own judgment about each person. 4Keeps does not supervise, control, or take responsibility for the actions, conduct, statements, accuracy of information, or safety of any member, client, match, or third party, whether online or offline.
Any coaching offered by or through 4Keeps is for general dating and personal-growth support only. It is not therapy, counseling, medical or psychological treatment, or a substitute for care from a licensed professional, and it does not create any therapist-client or other professional relationship. If you are experiencing a mental health concern, please consult a qualified professional.
The Site and all services are provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. 4Keeps does not warrant that the Site or services will be uninterrupted, error free, or secure, or that any introduction will result in a date, a relationship, or any other outcome.
To the fullest extent permitted by law, 4Keeps and its owners, employees, contractors, matchmakers, and affiliates will not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, or for any loss of profits, data, or goodwill, or for any personal injury, emotional distress, or property damage, arising out of or relating to your use of the Site or services, any introduction, or the conduct of any member, client, match, or third party, whether based in contract, tort, or any other theory, even if 4Keeps has been advised of the possibility of such damages. In no event will 4Keeps' total aggregate liability for all claims relating to the services exceed the total amount you actually paid to 4Keeps in the three (3) months immediately preceding the event giving rise to the claim. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
Because 4Keeps does not control the people it introduces or their conduct, you release and discharge 4Keeps and its owners, employees, contractors, matchmakers, and affiliates from any and all claims, demands, damages, and liabilities of every kind, known and unknown, arising out of or in any way connected with any interaction, communication, date, or relationship with any member, client, match, or third party.
You agree to defend, indemnify, and hold harmless 4Keeps and its owners, employees, contractors, matchmakers, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the services, your interactions with any other person, your violation of these Terms, or your violation of any law or the rights of any third party.
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these Terms or the services will be resolved exclusively in the state or federal courts located in Los Angeles County, California, and you consent to their jurisdiction.
We treat your personal information with confidentiality and professionalism. Your name and contact details are not shown to potential matches, and identifying details are shared with a prospective match only with your approval. See our Privacy Policy for details on how we collect and use information.
Waiver. Any waiver or failure to enforce any provision of the Terms on one occasion will not be deemed a waiver of any other provision or of such provision on any other occasion. Severability. If any provision of the Terms is held to be invalid or unenforceable, the other provisions will remain enforceable, and the invalid or unenforceable provision will be deemed modified so that it is valid and enforceable to the maximum extent permitted by law. Entire agreement. The Terms are the final, complete, and exclusive agreement of the parties with respect to the subject matter hereof and supersede all prior discussions.
